Technical requirements

Pursuant to the Law on Foreign Trade Transactions and for the purposes of protecting human, plant and animal life, health and safety, as well as the environment, or for the purposes of protecting other public interest, all technical and other requirements may apply to importation of goods. Technical regulations, in the context of the law governing technical requirements and conformity assessment of products with such requirements, apply to all products, regardless of their origin. Application of such technical regulations may not result in additional restriction of importation.

When importing goods listed in Annex 5A of the Decision on Determining Goods Subject to Issuance of Specific Documents on Importation, Exportation or Transit, it is necessary to obtain a document of conformity or an act issued by the competent ministry on recognition of validity of foreign documents or marks of conformity. Documents of conformity are issued by the manufacturer, appointed conformity assessment body or a competent state administration authority, in line with the Law on Technical Requirements for Products and Conformity Assessment and in accordance with relevant technical regulations.

For imports of the goods listed in Annex 5A of the Decision, the importer is to submit to the relevant customs authority one of the following documents:

Supported by

Certificate issued by a domestic conformity assessment body;
Decision on recognition of validity of a foreign document of conformity issued by the competent ministry;
Excerpt from the register of foreign documents and marks of conformity valid in Serbia, issued by the Ministry of Economy and Regional Development;
Certificate of conformity issued by the domestic appointed conformity assessment body;
Excerpt from records on issued certificates of conformity issued by the domestic appointed body having issued the Certificate of conformity for the specific product.

Annex 5B of the Decision on Determining Goods Subject to Issuance of Specific Documents on Importation, Exportation or Transit lists the goods that require a certificate on homologation on importation, which is issued by the Agency for Traffic Safety.

Annex 6 of the same Decision lists goods the importation of which is subject to the approval of the Republic Agency for Electronic Communications (telecommunication equipment).

Quality Infrastructure Sector, as an organizational unit within the Ministry of Economy and Regional Development, creates and implements quality infrastructure strategy and policy in Serbia through legislative and operational activities in the areas of standardization, accreditation and metrology, in line with the EU acquis communautaire related to free movement of goods and internal market.

Quality Infrastructure Sector is made up of three internal units:

1.Unit for Development Strategy and Policy of Standardisation, Accreditation and Metrology, with two groups: Group for Standardisation and Accreditation and Group for Metrology;
2.Technical Regulations and Conformity Assessment Unit that includes Group for Technical Regulations and Group for Conformity Assessment; and
3.Group for Registers and Cooperation with International Organizations, where the Enquiry Point for Technical Regulations was established.

With the objective of forming a single enquiry point for technical legislation in Serbia, the project of developing a portal, application software and database– TEHNIS was implemented.

Quality Infrastructure Sector within the Ministry of Economy and Regional Development has developed the TEHNIS portal in order to facilitate obtaining information on technical requirements that the products placed on the market in the Republic of Serbia must meet.

Providing information is the aspect of TEHNIS that deserves attention. TEHNIS was developed to assist economic operators, producers, traders and market surveillance authorities when placing products on the market in the Republic of Serbia, but it is still up to the producers to assess which are the regulations or requirements that their products must meet.
